1. The short version
If you believe something on InstantSam infringes your copyright, send a written notice to our designated agent, below, with the six things in section 3. We act on a complete notice promptly.
InstantSam is software for reading government solicitations. Customers upload files to their own teams, such as a proposal draft, a quote or a capability statement, and the service shows text it has read from public government notices. This page is for claims about material that is on the service.
2. Our designated agent
These are the details filed with the U.S. Copyright Office’s DMCA Designated Agent Directory.
- Agent
- Copyright Manager
- Company
- InstantSam LLC
- Address
- 6464 Savoy Drive, Suite 777, Houston, TX 77036
- Telephone
- 800-410-0438
Use this address for copyright notices only. For anything else, write to support@instantsam.com.
3. What a notice has to contain
- Your physical or electronic signature, or that of a person authorized to act for the owner of the right.
- A description of the copyrighted work you say has been infringed. If one notice covers several works in one place, a representative list is enough.
- A description of the material you say infringes, with enough information for us to find it: an address on instantsam.com, or the name of the file and, if you know them, the account or team.
- Your name, address, telephone number and email address.
- A statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law.
- A statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner of the right or are authorized to act for the owner.
A notice that leaves one of these out may not be enough for us to act on. If so, we will write back and say what is missing.
Knowingly claiming that material infringes when it does not, or that it was removed by mistake when it was not, can make the person who says so liable for damages, including costs and attorney’s fees (17 U.S.C. 512(f)).
4. What we do with a notice
When we receive a notice with these things in it, we remove the material or disable access to it promptly, and we tell the account that holds it, with a copy of the notice. If the material was a customer’s own file, they can answer it as described in section 5.
5. If your material was removed
If you believe it was removed by mistake or because it was misidentified, send our agent a counter notice with:
- Your physical or electronic signature.
- A description of the material that was removed and where it was before it was removed.
- A statement, under penalty of perjury, that you believe in good faith that the material was removed by mistake or misidentification.
- Your name, address and telephone number.
- A statement that you consent to the jurisdiction of the federal district court for the district where your address is (or, if it is outside the United States, any district where InstantSam can be found), and that you will accept service of process from the person who sent the original notice.
We send a complete counter notice to the person who sent the notice. Between 10 and 14 business days after we receive it, we restore the material, unless before then we are told that the person who sent the notice has filed a court action to stop it.
6. People who repeatedly infringe
In appropriate circumstances, we end the accounts of people who repeatedly infringe copyright.
7. This page is not legal advice
It describes how we handle notices under section 512 of the U.S. Copyright Act. If you are unsure of your rights, ask a lawyer. Our Terms of Service and Privacy Policy are separate.
